These Terms of Service ("Terms" or "Agreement") govern your access to and use of our website, services, and products, including the software, digital license keys, and any other products we make available through our platform (collectively, the "Service"). By accessing or using the Service, you agree to be legally bound by these Terms. Please read these Terms carefully as they contain important legal information about your rights and obligations when using our Service.

If you do not agree to these Terms, you are not permitted to use or access the Service. Your use of the Service is contingent upon your acceptance of these Terms in full.

These Terms are entered into by and between TropicalCheats and you, the user of the Service ("you" or "User"). By accessing or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You further acknowledge that you have the legal capacity to enter into binding agreements.

We reserve the right to modify, amend, or revise these Terms at any time, in our sole discretion. Any modifications will become effective immediately upon being posted on the website, unless otherwise stated. It is your responsibility to regularly review these Terms. In order to purchase products or access certain features of the Service, you must create a User account. During registration, you will be required to provide accurate and complete information, including but not limited to your name, email address, and address. You are responsible for ensuring that this information remains accurate and up-to-date.

3.1 Digital Software Resale

TropicalCheats operates as a reseller of digital software products. By purchasing a product through our website, you acknowledge and agree that you are purchasing a digital license key which is used to activate third-party software. You further understand that we are not the original developers of the software, and as such, any issues or concerns regarding the software itself should be directed to the respective software owner or manufacturer.

3.2 License Keys

Upon successful payment, customers will receive access to their digital license keys via their account’s "License Key" tab. The delivery of the license key constitutes full completion of the transaction. TropicalCheats is not responsible for any issues that may arise due to the misuse, improper installation, or user error in activating the software.

4. Payments and Billing

4.1 Payment Methods

We accept payments through Stripe (credit and debit cards) and PayPal. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the payment information is accurate and complete. You agree to promptly update your account with any changes to your billing details.

4.2 Recurring Billing and Subscriptions

Some products and services offered through the Service may be available on a subscription basis, requiring recurring payments. By subscribing, you authorize TropicalCheats to charge your payment method at regular intervals as specified during the subscription process. You may cancel a subscription at any time through your account dashboard; however, cancellation will only take effect at the end of the current billing cycle, and no prorated refunds will be issued for partially used periods.

4.3 Price Changes

TropicalCheats reserves the right to modify pricing for any products or subscriptions at any time. We will provide notice of any price changes via email or by posting on the website. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.

5. Refunds and Cancellations

5.1 Refund Policy

We offer refunds within seven (7) days of the purchase date for all products under the following conditions:

  • The digital license key does not work or is invalid.

  • You are unable to use the product due to technical issues that our support team cannot resolve.

Refund requests must be submitted through our Discord server via a ticket. We reserve the right to deny refund requests that we determine to be fraudulent or in violation of our policies. Once a refund has been issued, your license key will be deactivated, and you will no longer be able to access the software.

5.2 Chargebacks and Disputes

Initiating a chargeback without first attempting to resolve the issue with TropicalCheats through our support team may result in the immediate suspension of your account. We take fraudulent chargebacks seriously and will take legal action if necessary. We kindly ask that you contact us prior to filing a dispute with your payment provider to allow us the opportunity to resolve the issue.

6. User-Generated Content

6.1 Reviews and Feedback

Users may submit reviews of products or services through external platforms, such as Trustpilot. By submitting any content, including reviews, you grant TropicalCheats a non-exclusive, royalty-free, perpetual, irrevocable, and fully transferable license to use, reproduce, modify, publish, and distribute such content.

You agree that your content will not:

  • Contain defamatory, libelous, or otherwise unlawful material.

  • Violate any third-party intellectual property or privacy rights.

  • Contain offensive or inappropriate language.

TropicalCheats reserves the right to remove or refuse to post any content that violates these Terms or is otherwise objectionable.

7. Intellectual Property and Ownership

7.1 Ownership of Content

All content provided on the TropicalCheats website, including but not limited to software, digital assets, trademarks, logos, text, images, videos, and design elements, is the property of TropicalCheats or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, distribution, or modification of any content is strictly prohibited without express written permission from TropicalCheats.

7.2 Third-Party Content and Trademarks

TropicalCheats is not affiliated with or endorsed by any third-party software companies, and any trademarks or logos appearing on our website are the property of their respective owners. By displaying such content, TropicalCheats does not imply any affiliation with or endorsement by these companies.

8. Prohibited Use

8.1 Restricted Access

Individuals associated with any anti-cheat organization or gaming company (including but not limited to Evenbalance, Valve, Activision Publishing, Electronic Arts, Smilegate, Epic Games, BattleEye Innovations, Easy Anti-Cheat, Take-Two Interactive, Rockstar Games and others) are strictly prohibited from accessing or using the Service. By entering the website, you certify that you are not an employee or agent of any such organization, nor are you accessing the Service for investigative purposes.

8.2 Misuse and Violations

Users agree not to engage in any of the following prohibited activities:

  • Sharing or transferring your account to another person or entity.

  • Misusing the software, including reverse engineering, decompiling, or distributing it in violation of the software’s license.

  • Attempting to gain unauthorized access to the Service or any other accounts, networks, or systems.

  • Violating any applicable laws or regulations while using the Service.

Any violation of this section may result in the suspension or termination of your account and legal action.

9. Privacy and Data Protection

9.1 User Data

TropicalCheats collects minimal personal data necessary to facilitate transactions and provide access to purchased products. This includes account registration information and order details. 10. Jurisdiction, Governing Law, and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. By using the Service, you agree to submit to the exclusive jurisdiction of the courts located in CT, for the resolution of any disputes arising from these Terms or your use of the Service.

10.2 Dispute Resolution

Before pursuing formal legal action, we ask that you first attempt to resolve any disputes by contacting us at legal@tropicalcheats.com. In the event that a resolution cannot be reached, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration will take place in CT, unless otherwise agreed upon by both parties.

10.3 Chargebacks and Account Termination

We reserve the right to permanently terminate any user account associated with a fraudulent chargeback or dispute.
